- Your violation of any applicable law, regulation, or ordinance;

The Federal Trade Commission Act (FTC Act) and all applicable federal consumer protection laws shall govern our advertising and business practices.
10. Dispute Resolution
10.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact Costa Vida at [email protected] and attempt to resolve the dispute informally. We will use good-faith efforts to resolve any complaint or dispute within thirty (30) days of receiving your written notice. If the dispute is not resolved informally within that period, either party may proceed to formal dispute resolution as set forth below.
10.2 Binding Arbitration
EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE SERVICES SHALL BE RESOLVED BY BINDING ARBITRATION IN ACCORDANCE WITH THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA), AS MODIFIED BY THIS SECTION.
The arbitration shall be conducted by a single neutral arbitrator. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
10.3 Class Action Waiver
YOU AND COSTA VIDA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, BOTH YOU AND COSTA VIDA WAIVE ANY RIGHT TO A JURY TRIAL AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
10.4 Small Claims Court
Notwithstanding the above, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction, provided the action remains in that court and is not removed or appealed to a court of general jurisdiction.
11. Term and Termination
